Frequently asked questions

Yes, where they are properly communicated and incorporated into the employment relationship. Policies referenced in employment contracts, acknowledged by employees in writing, and consistently applied are binding. Policies that contradict statutory rights are unenforceable, regardless of employee acknowledgment.
Core policies include: code of conduct, anti-harassment and grievance procedures, disciplinary and termination procedures, health and safety, IT and data protection, leave entitlements, remote work, and travel and expenses. Sector-specific policies may also be required. The handbook should be reviewed annually for legal updates.
 
A defensible disciplinary process includes: written warnings for less serious misconduct, escalating sanctions for repeat issues, an investigation before any termination, the employee’s right to respond, and clear documentation throughout. UAE labour law lists specific grounds for summary dismissal, which must be strictly proven.
While not all sectors have explicit statutory anti-harassment policy requirements, UAE law prohibits harassment and discrimination in the workplace. A clear anti-harassment policy, combined with training, complaints channels and prompt action, is essential for managing legal exposure and protecting affected employees.

At minimum annually, and immediately after any significant change in UAE labour law or sector regulation. The 2022 labour law reform, the corporate tax regime, and ongoing Emiratisation updates have all required policy revisions. Policy currency is a frequent issue in employment disputes and labour authority audits.
