Frequently asked questions

Custody is governed by the law of the country where the children habitually reside. If they live in the UAE, UAE law applies, regardless of the parents’ nationalities or where the marriage took place. This is a critical point many expat parents overlook.
Under UAE civil law, there is no fixed age at which a child’s preference becomes legally binding. Judges consider the child’s best interests and may take the child’s wishes into account from around age 7 or older, but the decision always rests with the court.
 
Not without the other parent’s consent or a court order. Taking children out of the country without permission can constitute parental abduction, which carries serious criminal and civil consequences. You must obtain formal authorisation before any international relocation.
Under UAE civil family law, financial support for children covers education, healthcare, housing and living expenses. The court assesses the father’s income and the child’s needs. There is no fixed formula. Amounts are determined case by case, and can be challenged or revised.

Violations of court custody orders can be enforced through criminal complaints and contempt of court procedures. Repeated non-compliance can lead to modification of the custody arrangement. Acting quickly and documenting violations is essential, as delays weaken your position.
