Real Estate Disputes

Clear, practical legal support for real estate disputes in the UAE, helping you protect your rights, family, assets and future.

Real Estate Disputes

Real estate disputes in the UAE move through tight deadlines and specific regulatory bodies – RERA, the DLD, and the Rental Dispute Settlement Centre. We handle contract cancellations, investor recovery from stalled projects, landlord/tenant disputes, and contractor claims.

In-depth description

Real estate disputes in the UAE – whether with a developer, a contractor, or a co-party in a transaction – require rapid, decisive legal action. Delays can affect RERA filing deadlines and enforcement timelines. Our team handles the full range of property disputes.

Contract Cancellation with RERA, developer or seller

If your property agreement has been breached, we provide expert legal assistance to terminate the contract. We represent you in negotiations with the developer or seller and, if necessary, file for official termination through the Dubai Land Department (DLD) or RERA, working to secure the refund of your investment.

Scope of work

  • Review the property contract to identify the grounds for termination (e.g., breach by the other party).
  • Attempt to negotiate an amicable termination and refund with the developer or seller.
  • If negotiation fails, draft and file a formal termination case with the Dubai Land Department (DLD)/RERA or the relevant authority.
  • Represent the client in all proceedings to secure an official termination order.

Deliverables

  • A legal opinion on the grounds for termination.
  • Representation in negotiations and/or DLD proceedings.
  • An official termination order.

Pricing

  • AED 10,000 onward (Hourly rate)

Project Cancellation through RERA or the Court

When an entire real estate project is cancelled or stalled indefinitely, we represent affected investors to recover their funds. We act on your behalf in the official liquidation or cancellation proceedings initiated by RERA or the Dubai Courts, navigating the complex legal process to reclaim your investment from the project’s escrow account.

Scope of work

  • Verify the official status of the project through RERA and the DLD.
  • Prepare and file a legal claim on behalf of the client with the special judicial committee or court handling the project’s liquidation.
  • Collate all proof of payment and other documentation to substantiate the claim.
  • Represent the client’s interests throughout the lengthy liquidation and fund recovery process.

Deliverables

  • A filed legal claim in the official project cancellation proceedings.
  • Ongoing representation and status updates.

Pricing

  • AED 10,000 onward (Hourly rate)

Landlord/Tenant Dispute

Disputes between landlords and tenants can be stressful and disruptive. Our service is designed to provide clear, effective legal representation to protect your rights, whether you are a landlord seeking to enforce a contract or a tenant facing an issue. Our team possesses in-depth knowledge of Dubai’s tenancy laws and the specific procedures of the Rental Dispute Settlement Centre (RDC). We manage all types of disputes—including those over rent increases, eviction, maintenance, and security deposits—aiming to resolve your case efficiently, from strategic negotiation to robust representation before the RDC.

Scope of work

  • Review the tenancy contract (Ejari) and advise on the client’s legal position.
  • Attempt to negotiate an amicable settlement with the opposing party.
  • If negotiation fails, draft and file a formal dispute case with the Rental Dispute Settlement Centre (RDC).
  • Represent the client in all RDC hearings to obtain a final, enforceable judgment.

  • A legal advisory note on the case merits.
  • Representation in negotiations and all RDC proceedings.
  • The final RDC judgment.

  • AED 15,000 onward (Fixed Fee depending on the rental amount or dispute complexity)

Engineer / Contractor Disputes

We represent property owners in disputes against engineers or contractors. If you are facing issues such as construction defects, project delays, or unjustified cost claims, we provide vigorous legal representation. We handle cases through negotiation, expert determination, arbitration, and court litigation to enforce your contract and seek compensation for damages.

Scope of work

  • Conduct a thorough review of the construction contract and the nature of the dispute (e.g., defects, delays, costs).
  • Obtain an initial assessment from an independent engineering expert, if required.
  • Represent the client in pre-litigation negotiations to seek a settlement.
  • If unresolved, represent the client in the contractually agreed forum, whether arbitration or the Dubai Courts.

Deliverables

  • A case assessment and strategy memorandum.
  • Representation in negotiations, arbitration, or court litigation.

Pricing

  • AED 20,000 onward (Fixed Fee depending on the project value or dispute complexity)

Frequently asked questions

RERA (Real Estate Regulatory Authority) is Dubai’s property regulator. It oversees landlord-tenant disputes through the Rental Disputes Centre (RDC). For off-plan and developer disputes, RERA mediates and refers unresolved cases to courts. Procedures are strict and deadlines are tight.
Cancellation rights depend on your contract and the developer’s registration status with RERA. Serious developer delays or insolvency can trigger a right to cancel and claim a refund. However, the process requires a formal claim and can take months. Early legal advice significantly improves outcomes.

You can file a claim with the Rental Disputes Centre (RDC) in Dubai or the relevant authority in your emirate. The process is relatively quick and cost-effective. Document the property’s condition at move-in and move-out thoroughly; this evidence is central to any deposit dispute.
No. Under UAE tenancy law, rent cannot be increased during an active lease period. Increases at renewal must comply with the RERA Rent Index (in Dubai) and require 90 days’ written notice before the lease ends. Increases above the permitted index cap can be contested through the RDC.

Limitation periods vary by dispute type. For rental disputes, claims must typically be filed within three years. For property purchase defects, different periods apply. Missing a deadline permanently bars your claim, so if you believe you have a dispute, do not delay seeking legal advice.
