Frequently asked questions

UAE rent increases are regulated by the RERA Rent Index. A landlord may only increase rent at renewal if the current rent falls below the index benchmark, and must give 90 days written notice. The permissible increase is capped based on how far below the index the current rent sits. Increases above the cap are unlawful and challengeable at RERA.
Ejari is the official Dubai tenancy registration system, managed by RERA. All contracts must be registered before the tenancy has full legal standing. Without it, tenants cannot apply for utilities, residency visas or RERA dispute resolution. Registration is the tenant’s responsibility unless the contract specifies otherwise.
 
If a developer misses the agreed handover date, UAE law and RERA provide remedies including compensation and the right to terminate the SPA and recover your funds. The strength of your claim depends on the SPA terms, cause of delay, and whether the project is RERA-registered with proper escrow. Early legal advice is critical.
Subletting in the UAE requires explicit written consent from the landlord. If the contract prohibits it or is silent, subletting without permission is grounds for eviction. Before subletting, review your contract carefully and get written approval. In Dubai, any sub-tenancy should also be registered on Ejari.

A UAE landlord can only deduct from the security deposit for documented damage beyond normal wear and tear, or unpaid rent and utilities. An unjustified refusal to return the deposit can be challenged at RERA’s dispute resolution centre, which handles these claims quickly and without requiring a lawyer.
